Emma Roake

Legal Director

Emma graduated with an honours degree in English Language and Literature from Oxford University in 2000. She completed her legal exams at the College of Law, London, before joining Fox Williams in 2003 to commence her training.

Since qualifying with the firm in 2005, Emma has provided a broad range of advice to principals/suppliers and agents in respect of both contentious and non-contentious matters.

Emma regularly:

  • assists businesses to put in place agency and distributorship agreements which protect their rights in respect of their UK and overseas agents and distributors;
  • advises principals on how best to manage the termination of their agreements with agents in order to minimise their exposure under the Commercial Agents (Council Directive) Regulations 1993;
  • advises principals on claims made against them by former agents under the Commercial Agents (Council Directive) Regulations 1993; and
  • advises agents on claims against their former principals for compensation or an indemnity payment under the Commercial Agents (Council Directive) Regulations 1993.

Some of Emma’s recent work includes:

  • advising a specialist supplier of metals and alloys to put in place agency and distributorship agreements;
  • assisting a sportswear brand to terminate the agreements which it had with a number of agents in a way which minimised the risk of claims under the Commercial Agents (Council Directive) Regulations 1993;
  • advising a large fashion brand on its exposure under the Commercial Agents (Council Directive) Regulations 1993 in respect of a former agent’s six-figure claim for compensation under the Commercial Agents (Council Directive) Regulations 1993;
  • assisting a well-known fashion brand to negotiate a settlement of a former agent’s claim for compensation;
  • advising a womenswear agent on its claims for an indemnity payment against a large multi-national womenswear brand; and
  • advising a footwear brand in respect of its potential exposure on the termination of a distribution agreement with a distributor in South East Asia.

Emma is also a member of the firm’s fashion law team.

Outside of the office, Emma has a keen interest in wildlife photography.
